Restoration Seeds is committed to your growing success. We want you, our customer, to be 100% satisfied with all of our seeds, bulbs, tubers, corns, roots, ("seeds"). If anything you purchase from us proves unsatisfactory, we will either replace the item or refund the purchase price. See our Returns and Exchanges policy.
Disclaimer of Guarantee (Warranty)
Restoration Seeds and its affiliates warrants seed it sells conforms to the label description as required by state and federal law. No other express guarantee or warranty is made in respect thereof. The liability of Restoration Seeds for breach of guarantee (warranty), or for any loss or damage arising out of the purchase or use of its seeds or other products, including loss or damage resulting from negligence or strict liability in tort, shall be limited to replacement of the dissatisfactory item or refund of the purchase price. Nor shall Restoration Seeds be liable for any incidental or consequential loss or damage, including any loss or damage resulting from negligence or strict liability in tort.
Restoration Seeds limits to such purchase price its liability of any kind on account of any negligence whatsoever on its part with respect to such seeds. Failure of the seed to germinate, yield and quality reduction may occur as a result of environmental factors including: cold temperatures, heat, excess moisture, drought, wind, hail, pests, inadequate fertility, misapplication of pesticides, planting date, planting location, sowing depth, soil type, irrigation practices and insect, disease and weed pressures, other acts of nature, destruction or loss after the seeds leave our premises, are in shipment and after delivery to your premises or mail box.
By the acceptance of the seed, the buyer acknowledges the limitations and disclaimers are conditions of sale and that they constitute the entire agreement between the parties regarding warranty or any other liability. Purchase constitutes acceptance of 100 percent of the risk involved in growing the seed. Purchase further constitutes agreement that in the event of a dispute, to participate in and to pay their party's fees, about $30 per hour, for the Oregon Department of Agriculture Farm Mediation Program as authorized in Oregon Revised Statute (ORS) 36.250–36.270.
NOTE All claims must be submitted to Restoration Seeds in writing no more than 30 days from the date of purchase.
